Terms of Service for ListMania

Effective Date: 22 August 2025

Agreement to Terms

By downloading, installing, or using the ListMania application (the "App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the App.

 

Description of Service

ListMania is a productivity application that allows users to create, manage, and organize lists. The App provides features including:

  • List creation and management

  • Item organization and categorization

  • iCloud synchronization across Apple devices

  • Data export capabilities

 

License to Use

Grant of License

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to use ListMania solely for your personal, non-commercial use on your device(s).

 

License Restrictions

You may not:

  • Copy, modify, or distribute the App

  • Reverse engineer, decompile, or disassemble the App

  • Create derivative works based on the App

  • Use the App for any commercial purpose without express written consent

  • Remove or alter any copyright, trademark, or other proprietary notices

  • Use the App in any way that violates applicable laws or regulations

 

User Accounts and Data

iCloud Integration

  • The App integrates with Apple's iCloud service for data synchronization

  • You must have a valid Apple ID and iCloud account to use sync features

  • Your use of iCloud is governed by Apple's Terms of Service and Privacy Policy

  • We are not responsible for iCloud service availability or functionality

 

Data Ownership

  • You retain full ownership of all content you create using the App

  • You are responsible for the accuracy and legality of your content

  • You grant us no rights to your content beyond what is necessary to provide the App's functionality

 

Data Backup

  • While the App syncs with iCloud, you are responsible for maintaining your own backups

  • We recommend regularly exporting your data as an additional backup measure

  • We are not liable for any data loss, corruption, or unavailability

 

Acceptable Use

Permitted Uses

You may use ListMania to:

  • Create personal lists and organize your information

  • Sync your data across your Apple devices

  • Export your data in supported formats

  • Customize the App's appearance and settings

 

Prohibited Uses

You may not use ListMania to:

  • Store or organize illegal content

  • Violate any local, state, national, or international law

  • Infringe upon others' intellectual property rights

  • Store sensitive personal information of others without consent

  • Create content that is harmful, threatening, abusive, or discriminatory

  • Attempt to gain unauthorized access to the App or related systems

 

Intellectual Property

Our Rights

  • ListMania, including its design, code, and functionality, is owned by us and protected by copyright and other intellectual property laws

  • All trademarks, service marks, and logos used in the App are our property or the property of their respective owners

  • These Terms do not grant you any rights to our intellectual property

 

Third-Party Content

  • The App may include third-party components subject to separate license terms

  • Any third-party content is the property of its respective owners

  • Your use of third-party content is subject to their applicable license terms

 

App Store Terms

  • Your use of ListMania is also subject to the Apple App Store Terms of Service

  • In case of conflict between these Terms and Apple's terms, Apple's terms take precedence for App Store-related matters

  • Apple is not a party to these Terms and has no responsibility for the App or your use of it

 

Updates and Modifications

App Updates

  • We may release updates to improve functionality, fix bugs, or add features

  • Updates may be delivered through the Apple App Store

  • Some updates may require you to accept new terms or conditions

  • Continued use after updates constitutes acceptance of any changes

 

Terms Updates

  • We reserve the right to modify these Terms at any time

  • Material changes will be communicated through the App Store or within the App

  • Your continued use after changes constitutes acceptance of the new Terms

  • If you don't agree to changes, you should stop using the App

 

Disclaimers and Warranties

No Warranty

THE APP IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND. WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

  • MERCHANTABILITY

  • FITNESS FOR A PARTICULAR PURPOSE

  • NON-INFRINGEMENT

  • ACCURACY OR COMPLETENESS OF DATA

  • UNINTERRUPTED OR ERROR-FREE OPERATION

Third-Party Services

  • We disclaim any warranties regarding Apple's iCloud service

  • We are not responsible for iCloud downtime, data loss, or service changes

  • Third-party service availability and functionality are beyond our control

 

Limitation of Liability

Limitation of Damages

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR:

  • INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES

  • LOSS OF DATA, REVENUE, OR PROFITS

  • BUSINESS INTERRUPTION OR LOSS OF USE

  • DAMAGES ARISING FROM YOUR USE OR INABILITY TO USE THE APP

 

Maximum Liability

Our total liability to you for any claims related to the App shall not exceed the amount you paid for the App (if any) in the twelve months preceding the claim.

 

Indemnification

You agree to defend, indemnify, and hold us harmless from and against any claims, damages, obligations, losses, liabilities, costs, or debt arising from:

  • Your use of the App

  • Your violation of these Terms

  • Your violation of any third-party rights

  • Any content you create or store using the App

 

Privacy

Your privacy is important to us. Please review our Privacy Statement, which explains how we collect, use, and protect your information. By using the App, you consent to our privacy practices.

 

Termination

Termination by You

  • You may stop using the App at any time by deleting it from your device

  • To remove your data from iCloud, disable iCloud sync for ListMania in your device settings

  • Your obligations under these Terms survive termination

Termination by Us

We may terminate or suspend your access to the App if:

  • You violate these Terms

  • We discontinue the App

  • Required by law or legal process

  • Technical or security reasons require it

Effects of Termination

Upon termination:

  • Your license to use the App ends immediately

  • You must delete the App from all devices

  • Provisions regarding liability, indemnification, and dispute resolution survive

 

Export Control and International Use

  • The App may be subject to export control laws and regulations

  • You are responsible for complying with all applicable laws in your jurisdiction

  • We make no representation that the App is appropriate or available for use outside the United States

 

Governing Law and Disputes

Governing Law

These Terms are governed by the laws of [Your State/Country], without regard to conflict of law principles.

Dispute Resolution

Any disputes arising from these Terms or your use of the App will be resolved through:

Apple Disclaimer: Apple Inc. is not a party to these Terms and is not responsible for the App or its content. Apple's liability is limited to the maximum extent permitted by applicable law. Apple and its subsidiaries are third-party beneficiaries of these Terms, and Apple has the right to enforce these Terms against you.

App Store: This agreement is between you and us only, not with Apple. We, not Apple, are solely responsible for ListMania and its content.
